These SMS/Text Messaging Terms (“SMS Terms”) govern your participation in the text messaging program operated by Life with Kate Inc. (“Life with Kate,” “we,” “us,” or “our”).

1. OVERVIEW

These SMS/Text Messaging Terms (“SMS Terms”) govern your participation in the text messaging program operated by Life with Kate Inc. By enrolling in our SMS program, you agree to these SMS Terms, our Privacy Policy, and our Terms of Service. If you do not agree, please do not enroll and do not submit your mobile number.

2. PROGRAM DESCRIPTION

The Life with Kate SMS program delivers promotional, educational, transactional, and account-related text messages to subscribers interested in nervous system health, chronic pain recovery, and related wellness content and programs offered by Life with Kate.

3. EXPRESS WRITTEN CONSENT (OPT-IN)

You may enroll in the SMS program by:

  • Submitting your mobile number through a form on our website (including checkout pages, landing pages, lead forms, and program enrollment pages) and affirmatively checking the SMS consent box;
  • Texting a designated keyword to our SMS number;
  • Replying YES (or a similar affirmative) to a confirmation message after providing your number; or
  • Providing your mobile number during a program enrollment, consultation, or event with an explicit SMS opt-in step.

By opting in, you provide your express written consent to receive recurring automated marketing and informational text messages from Life with Kate Inc. at the mobile number you provide, sent via automatic telephone dialing system or similar technology.

Consent to receive SMS messages is not a condition of purchasing any goods or services from Life with Kate.

4. MESSAGE FREQUENCY

Message frequency varies. You may receive up to eight (8) marketing messages per month. You will also receive transactional messages (such as purchase confirmations, program access details, session reminders, and account updates) based on your activity, and these are not subject to the marketing frequency cap.

5. TYPES OF MESSAGES YOU MAY RECEIVE

  • Program launches, announcements, and events
  • Promotional offers, discounts, and sales
  • Educational content related to nervous system regulation, chronic pain, and general wellness
  • Enrollment and purchase confirmations
  • Program access links, course check-ins, and session reminders
  • Account notifications and service updates
  • Customer support responses

6. MESSAGE AND DATA RATES

Message and data rates may apply. Rates are determined by your wireless carrier and your mobile service plan. Life with Kate is not responsible for any charges you incur as a result of receiving or sending messages through this program. Please check with your carrier for details.

7. OPTING OUT / UNSUBSCRIBING

You may opt out of the SMS program at any time by:

  • Replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any message we send you; or
  • Emailing us at support@lifewithkate.com with “SMS UNSUBSCRIBE” in the subject line.

After opting out, you will receive one final confirmation message. You will no longer receive marketing SMS messages. You may still receive transactional or account-related messages (e.g., receipts, program access, appointment confirmations) tied to active purchases or accounts.

To re-enroll, reply START or UNSTOP to our SMS number, or opt in again via our website.

9. SUPPORTED CARRIERS

Supported carriers include AT&T, T-Mobile, Verizon Wireless, Sprint, Boost Mobile, U.S. Cellular, MetroPCS, Cricket Wireless, Google Fi, and most other major and regional U.S. carriers. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier service and network availability and is not guaranteed.

10. ELIGIBILITY

To enroll in the SMS program, you must be:

  • At least 18 years of age;
  • A legal resident of the United States; and
  • The account holder of the mobile number submitted, or authorized by the account holder to enroll that number.

You represent and warrant that the mobile number you provide is accurate, belongs to you (or is provided with the owner’s authorization), and is not a landline or number assigned to a third party without consent. You agree to notify Life with Kate immediately if your number changes or is reassigned.

11. PRIVACY

Your information is handled in accordance with our Privacy Policy, available at https://heal.lifewithkate.com/privacy. We do not sell, rent, or share mobile numbers or SMS opt-in data with third parties for marketing purposes. Mobile opt-in information is only shared with the service providers necessary to operate the SMS program (for example, our SMS platform provider), or as required by law.

12. WELLNESS AND MEDICAL DISCLAIMER

Life with Kate Inc. is a wellness education company. Text messages from Life with Kate are provided for informational and educational purposes only and do not constitute medical advice, diagnosis, or treatment. Our messages are not a substitute for care from a licensed physician, mental health professional, or other qualified healthcare provider.

You should consult with your physician or qualified healthcare provider before beginning any wellness program, especially if you have a medical condition, are taking medication, are pregnant or nursing, or are recovering from injury or surgery.

If you are experiencing a medical or mental health emergency, do not rely on SMS. Call 911 or go to your nearest emergency room. If you are experiencing a mental health crisis, call or text 988 (Suicide & Crisis Lifeline).

13. NOT FOR PROTECTED HEALTH INFORMATION (PHI)

SMS is not a secure or HIPAA-compliant communication channel. Do not send sensitive personal health information, medical records, or confidential information to Life with Kate via text message. We are not responsible for the security or privacy of information you transmit via SMS.

14. PROHIBITED CONDUCT

You agree not to:

  • Enroll a mobile number you do not own or are not authorized to enroll;
  • Use the SMS program for any unlawful purpose or in violation of these SMS Terms;
  • Attempt to disrupt, interfere with, or reverse-engineer the SMS program or the systems used to deliver it; or
  • Harass, abuse, or threaten our team through SMS replies.

We reserve the right to suspend or terminate your enrollment at our discretion for any violation of these SMS Terms.

15. CHANGES TO THESE SMS TERMS

We may update these SMS Terms from time to time. The “Last Updated” date reflects the most recent revision. Material changes will be communicated to active subscribers via SMS or email where required by law. Your continued participation in the SMS program after changes take effect constitutes your acceptance of the revised terms.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Life with Kate Inc., its officers, directors, employees, agents, and service providers shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your participation in the SMS program, including without limitation damages arising from undelivered, delayed, or erroneous messages, message content, or data charges incurred.

17. GOVERNING LAW

These SMS Terms are governed by the laws of the State of Idaho, without regard to its conflict of laws principles. Any dispute arising from these SMS Terms shall be resolved in accordance with the dispute resolution provisions of our Terms of Service.
